Scrambling and taking a fine is out of the picture seeing how they are making it a hostile act in the next patch, so the cops will show up. So, one less way of protection. Score another one for the bad guys on this one I guess.

Havn't seen it in practise, but a frigate orbiting a cruiser at 2-3k range when cruiser got projectile weapons whould be doing quite good. The tracking should be having real trouble getting in good shots.
